LOS ANGELES — Pierre Daniel, the chubby actor who sued Marlon Wayans for comparing him to a cartoon character, had his case thrown out of court on Monday. If you recall, Pierre accused the acclaimed funnyman of racial discrimination on the set of “A Haunted House 2″ after Marlon posted a side-by-side photo of him and Cleveland Brown with the hilarious caption: “Tell me this n**** don’t look like … THIS N****!!! Ol Cleveland Brown ass lookin.” The judge even found comedy in the comparison, saying, “The Cleveland Brown character, like [Pierre], obviously black, heavy … with curly ‘Afro’ hair were all incorporated humorously into the filming of the scene.”

The judge also cited freedom of speech as a key factor in the ruling. “I am grateful that the judge upheld our constitutional rights of free speech,” said Marlon after the decision.
“It’s the first amendment and probably the most important for a comedian. This is also a stride toward protecting public figures from often bogus claims and lawsuits. I am grateful now if you’ll excuse me I’m gonna go watch reruns of the Cleveland show.”
Although he came up short in his lawsuit against Marlon, Pierre still has an impending lawsuit against the production company. Stay tuned for updates.
